Terms of Service

These terms govern your use of The Recording Pod (“the Pod,” “we,” “us”), a podcast and video recording studio based in Woodbridge, Virginia, and our website and booking system. By booking a session, starting a plan, or creating an account, you agree to these terms.

Bookings & sessions

When you book a session you reserve studio time at a specific date and time. The base session is the recording itself; you receive your raw recording files. Editing and post-production are optional paid add-ons. Session length, guest limits, and what's included are described on each service page.

Payments

Payments are processed securely by Stripe. We never see or store your full card details. Session prices and add-ons are charged at checkout. Monthly plans and the Creator Membership are recurring subscriptions billed each month until cancelled.

Memberships & studio hours

The Creator Membership includes a monthly allotment of studio hours. Hours refill at the start of each billing period and do not roll over. A booking made with hours deducts time based on the session length. If you cancel a membership, you keep any remaining hours through the end of the period you have already paid for, after which hours stop refilling.

Cancellations & reschedules

You may reschedule or cancel a booked session. Cancellations made at least 24 hours before the session are eligible for a credit or, for member bookings, the hours are returned to your balance. Cancellations inside 24 hours, or no-shows, may not be refunded or credited. To change a session, use the link in your confirmation email or contact us.

Subscription cancellation

You can cancel a monthly plan at any time from your account's billing portal. Cancellation stops future renewals; it does not refund the current period. You retain access through the end of the period you have paid for.

Your content

You own the recordings made of you and your guests. You are responsible for having the rights and consent to record any participants and any material used in your session, and for how you publish the finished content.

Promotional use

By booking a session, you grant The Recording Pod a non-exclusive, royalty-free license to use photos, video, audio, clips, and the names and likenesses of you and your guests captured during or in connection with your session for our own promotional and marketing purposes. This includes our website, social media, advertising, demo reels, and portfolio. You confirm you have obtained this same consent from any guests you bring. If you would prefer we not feature your session, just email info@therecordingpod.com and we will exclude it. We will always honor a request to take down specific promotional content featuring you.

Acceptable use

You agree to treat the studio, equipment, and staff with care and to follow on-site directions. We may decline or end a session involving unsafe, unlawful, or abusive conduct.

Studio Space Rental Agreement (BYOG)

This Agreement is between The Recording Pod (“the Studio,” “we,” “us”) and the person or entity booking (“Renter,” “you”). By checking the acceptance box and completing payment you agree to be legally bound. If you book for a company or another person, you represent you are authorized to bind them.

1. License, not a lease. You receive a limited, revocable, non-exclusive license to use a designated portion of the Studio for your booked time block, for a photo or video shoot only. This creates no tenancy or real-property interest. We retain possession and control of the premises at all times. The license is personal to you and may not be transferred, shared, sublet, or resold.

2. Bring your own gear. This is a bring-your-own-gear rental. We provide the space, the existing studio lighting, and a painted matte-black backdrop wall. You supply everything else — any other backdrops or set pieces, and all cameras, lenses, memory, batteries, props, wardrobe, talent, and any shooter or crew. No Recording Pod cameras, mics, or recording equipment are included, except where you purchase the optional video-capture add-on ($125 flat per booked session, selected at checkout), under which a Pod operator records your session with our in-house cameras.

3. Attended. A Recording Pod team member (usually the owner) is on-site for your full block, to manage access and the room and to safeguard Studio equipment. Our staff are not your crew, assistants, stylists, or shooters and are not responsible for your creative or technical results.

4. Time, minimum, and buffers. The rate is $65.00/hour, two-hour minimum ($130.00). Your block includes your setup, shooting, and teardown. A reset and turnover buffer is reserved before and after every block — please do not arrive early and please wrap and clear on time. If you run past your booked end time, overage is billed at $65.00/hour in 30-minute increments (rounded up) to your card on file, and may be drawn from your deposit.

5. Off-peak only. Rentals are available off-peak. Weekday 1:00–6:00 PM ET is reserved for recording clients and is not available for rental. Only the times shown as available in the booking calendar may be booked.

6. The recording rig stays put. Do not touch, move, unplug, re-cable, re-aim, or power off the recording rig or any equipment marked as Studio equipment. Work only within the marked movable photo zone. Studio lighting can be adjusted or fully blacked out and the branded set concealed by Studio staff on request — do not reconfigure lighting or sets yourself. Any damage or loss from tampering with the rig is your responsibility in full, is not limited to the deposit, and will be charged to your card.

7. Your gear. You are solely responsible for your own equipment, media, footage, and property. The Studio provides no secure storage, is not a bailee of your property, and is not liable for loss, theft, or damage to your gear or footage. Do not leave valuables unattended.

8. $150 refundable deposit. A $150.00 refundable damage/cleaning deposit is authorized as a hold on your card in the days before your session (immediately at booking if your session is within about a week). It is an authorization, not a charge. If the space is returned clean and undamaged and your block ends on time, we release the hold the same day after an end-of-rental walkthrough; it clears in a few business days. We may capture part or all of it for damage, missing or relocated equipment, excessive cleaning (spills, tape/adhesive residue, glitter/confetti/powder, makeup or product on surfaces), or overstaying. The deposit does not cap your liability; costs above $150.00 remain your responsibility and may be charged to your card.

9. Backdrop wall and your materials. The painted matte-black backdrop wall is included; treat it with care. Do not tape, tack, paint, mark, drill, or lean gear against it. Marks, scuffs, paint, adhesive, or damage to the wall are billed as damage under Section 12 and may be drawn from your deposit. Any other backdrops, seamless, or set pieces are yours to bring and yours to remove at the end of your block.

10. Headcount. Total people on set — you, talent, and crew — may not exceed the number you booked, capped at 8, unless we approve more in writing beforehand. Exceeding the cap without approval may forfeit your deposit and end the session without refund.

11. Content policy; right to refuse. No adult, sexually explicit, pornographic, illegal, defamatory, harassing, hateful, or violent content, and no depiction of illegal activity on the premises. No food or drink on the sets, backdrops, or seamless (lidded water is fine, in the designated area). We may refuse, pause, or end any shoot that violates this policy or endangers people or property; in that case the rental fee is non-refundable and the deposit is released if not captured. Misrepresenting your shoot to obtain a booking forfeits the deposit and fee.

12. Cleanup and condition. Return the space as you found it: trash and belongings out, tape and adhesive removed, surfaces you soiled wiped, moved items returned to place. Normal reset is included; cleanup beyond that is billed at $75.00/hour (1-hour minimum) against the deposit and, if it exceeds the deposit, to your card.

13. Safety. Use only the outlets staff identify; do not overload circuits or run cabling across walkways untaped. No rigging, clamping, drilling, nailing, or suspending from walls, ceilings, or fixtures without staff approval. Haze, fog, smoke, open flame, pyrotechnics, firearms (real or replica), and hazardous materials are prohibited without prior written approval. Keep exits clear and follow staff safety instructions.

14. Releases, permits, and your content. You are solely responsible for all model, talent, and minor releases, and for any permits or client permissions your shoot requires. You retain ownership of the images and footage you create. The Studio does not use, keep, or claim any rights in your footage. The Studio will not use behind-the-scenes images of your shoot for its own marketing unless you opt in at booking; any such use excludes anything captured on your own cards and any confidential content. Note: the room contains fixed recording cameras that stay off during rentals unless you add an optional capture; Virginia is a one-party-consent jurisdiction.

15. No sublet or assignment. You may not sublet, assign, resell, share, or transfer your booking. The space may be used only by you and the party disclosed at booking, for the shoot described at booking.

16. Insurance. For standard personal or small creator shoots, no certificate is required. For commercial, client, or agency shoots, any party of six (6) or more, or shoots involving heavy grip, rigging, vehicles, or high-value equipment, you must carry general liability insurance of at least $1,000,000 per occurrence and, on request, provide a Certificate of Insurance naming The Recording Pod as additional insured for your booking date. We may review, condition, or decline such bookings before confirming; these bookings are handled as a quote request, not instant confirmation.

17. Assumption of risk; release. Use of a working studio carries inherent risks of injury and property damage. To the fullest extent permitted by Virginia law, you, for yourself and your party, release and discharge The Recording Pod, its owner, staff, and agents (“Released Parties”) from all claims arising from your use of the space, your equipment, or your shoot, including claims based on the Released Parties' ordinary negligence. This does not waive liability that cannot be waived under Virginia law, including willful or wanton misconduct.

18. Indemnification. You will defend, indemnify, and hold harmless the Released Parties from any claims, damages, losses, costs, and reasonable attorneys' fees arising from your use of the space, your gear, your party's acts or omissions, injury or property damage connected to your booking, your content, or your breach of this Agreement.

19. Limitation of liability. To the fullest extent permitted by law, the Released Parties' total liability arising from your booking will not exceed the rental fee you actually paid for that booking, and the Released Parties are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, footage, or data.

20. Cancellation. Cancel or reschedule at least 24 hours before your start time for a full refund of the rental fee. Inside 24 hours, or a no-show (not arriving within the first 30 minutes without notice), the rental fee is charged in full; the deposit is released if never captured. We may cancel for emergency, equipment failure, or unsafe conditions, in which case your sole remedy is a full refund of amounts paid.

21. Governing law. Virginia law governs, without regard to conflict-of-laws rules. Disputes are brought exclusively in the state or federal courts of Prince William County, Virginia, and you consent to that jurisdiction and venue.

22. Entire agreement. This Agreement plus the booking details you accepted at checkout is the entire agreement for your rental. If any provision is unenforceable, the rest stands. The version you accept at checkout governs your booking.

By checking the box and completing payment, you acknowledge you have read, understood, and agree to this Agreement, including the release of liability and indemnification above, and that this is a legally binding agreement.

Liability

We provide the studio and services with reasonable care, but to the extent permitted by law our liability for any claim related to a session or plan is limited to the amount you paid for it. We are not liable for indirect or consequential losses.

Changes

We may update these terms; the effective date above reflects the latest version. Continued use after an update means you accept the revised terms.
